Kanye & Kim Kardashian Won't Be Prosecuted For Taping Taylor Swift

It looks like Kanye West and Kim Kardashian may be saved from criminal prosecution by Rick Rubin.

In California, it's a crime to record or eavesdrop on any confidential communication, including a private conversation or telephone call, without the consent of all parties to the conversation.

And there were reports that Taylor Swift was thinking about having Kim and Kanye prosecuted for leaking a recording of a phone conversation in which she pre-approves part of 'Ye's controversial song 'Famous.'

However, the law also states that "confidential communication" does not include conversations that "may be overheard."

Since it appears Swift knew super producer Rubin and other third parties were listening to the conversation, it invalidates criminal charges.

It also makes it harder for her to sue.

But she can still stare at photos of her ex-Calvin Harris's new girlfriend Tinashe.
